"The introduction of the emergency arbitrator into the field international arbitration has been seen as the proper solution to keep a status quo in the interval between the request for arbitration and the constitution of the arbitral tribunal, especially when the claimant is seeking urgently for avoiding an irreparable harm or preserving evidence.
There are concerns regarding the possibility of enforcing—before national courts—the interim relief granted by emergency arbitrators. Such concerns are those related the form of the relief (whether order or award), the status of the emergency arbitrator in comparison with a standard arbitral tribunal, and the interim nature of the decision.
After addressing in a general manner the origin and the concept of the emergency arbitrator, this dissertation shows that the truth is these three concerns should not be more than unfounded worries and, thus, the enforcement of interim measures rendered by emergency arbitrators should be accomplished with the current legal framework on the issue."
